Implementation of The Precautionary Principle in Indonesian Environmental Law: A Case Study of Plastic Waste Management

Plastic waste management is a major issue in environmental law in Indonesia. The precautionary principle, as stipulated in Law No. 32/2009 on Environmental Protection and Management, is designed to minimize environmental impacts caused by plastic waste. However, the implementation of this principle faces various obstacles, such as limited recycling infrastructure, low public awareness, and weak law enforcement. This research aims to analyze the application of the prevention principle in plastic waste management, with a case study of management in Indonesia. The research method used is normative juridical with a literature study approach, reviewing relevant regulations and comparing them with waste management practices in several countries such as China and the European Union. The results show that despite the existence of a supportive legal framework, plastic waste management in Indonesia still requires significant improvement, especially in the aspects of law enforcement and incentivizing the community and industry players. This research recommends the implementation of Extended Producer Responsibility (EPR) policies, increased public education, and regional cooperation in facing the challenges of plastic pollution, especially in the Southeast Asia region.
